1.1 Promoter: The promoter is Mahindra & Mahindra Ltd. hereinafter referred to as "Mahindra"
or the "Promoter".
1.2 The eMPOWER Loyalty Program is open to eligible Participants only limited to the territory of
India as defined in 1.3 below.
1.3 An eligible Participant can be a mechanic enrolled by Business Associates of the Promoter
1.4 The reference to "you" means the Participant as defined in the Terms and Conditions. The
reference to "we" or "us" means both Mahindra and Grass Roots India jointly unless the context
otherwise requires or if only one of the above two parties is referred to in a particular clause.
Capitalized terms used therein but not defined will have the meaning ascribed to them under the
Terms and Conditions.
1.5 Merely participating in the eMPOWER Program shall not entitle you, the Customer
("Participant") for any benefits and/ or rewards and/ or payments ("Rewards") under the eMPOWER
Program which shall at all times be subject to the Terms and Conditions.
1.6 Mahindra or Grass Roots India will not pass Participants' personal details to any other
organization without their due permission to the extent permissible by law.
1.7 Reporting and payment of all applicable taxes, fees, and/or surcharges in relation to the
Rewards and / or Assured Gifts shall be the sole responsibility of the Participant.
1.8 Mahindra reserves the right to conduct checks of such kind and in such manner as it may
deem fit on the Participant's identity from time to time and the Participant hereby gives its
consent for the same.
1.9 Mahindra may modify/change these Terms and Conditions at its sole discretion any time
without any notice of any nature whatsoever to any person.
1.10 Mahindra, Dealers, Distributors, Retailers, consultants, contractors, advertising agencies
providing services to Mahindra and their respective employees, public relations agencies
providing services to Mahindra and their respective employees, marketing agencies providing
services to Mahindra and their respective employees; and their immediate families (parent,
child, siblings & spouse) are not eligible to participate in the eMPOWER Program. Mahindra.
reserves the right to withdraw the Initiative at any time without prior notice of any nature
whatsoever to any person.
1.11 The information submitted is the sole responsibility of the Participant and any Participant
who provides any illicit or illegal information of any nature whatsoever shall be liable for all
consequences relating thereto, including without limitation all penalties prescribed under
applicable laws. Mahindra and Grass Roots India disclaim all liability and responsibility in this
regard.
1.12 By participating in the Initiative, Participants agree to release, discharge and hold
harmless Mahindra and Grass Roots India and all associated and affiliated companies, officers,
directors, employees and agents from any and all damages, costs, expenses, and other
liabilities, including damages for personal injury or damage to property, whether the damages
are direct or indirect, and regardless of whether the claim is based on contract, tort or any other
legal theory, which may be due to or arise out of participation in the Initiative or the acceptance,
use/misuse or possession of the Rewards.
1.13 The Participant undertakes to indemnify Mahindra and Grass Roots India against any
loss, damage, claims, costs, expenses which may be incurred or suffered by Mahindra and / or
Grass Roots India due to breach of these Terms and Conditions.
1.14 Mahindra reserves the right to provide alternate gifts/ services/ vouchers of equivalent
value in place of the Rewards. Mahindra gives no warranty/guarantee whatsoever about the
nature, functioning or quality of the gifts/ services/ vouchers. Any warranties and guarantees on
such gifts/ services/ vouchers shall be as offered, if any, by the respective
manufacturers/suppliers/service providers.
1.15 Participant shall not by itself or with others participate in any illegal, deceptive, misleading
or unethical practices including, but not limited to, disparagement of products of Mahindra or
any of its affiliate companies or other practices, which may be detrimental to products or
Mahindra.
1.16 Mahindra reserves the right to terminate the eMPOWER Program or withdraw the Rewards
earned by a Participant in the event of an improper sale by the participant in violation of the
local law or when Mahindra has reason to believe that the Participant has breached any of the
Terms and Conditions contained here.
1.17 The Initiative is subject to Indian laws. All disputes in respect of the Initiative including
without limitation the Terms and Conditions contained herein are subject to jurisdiction of the
courts at Mumbai only.
1.18 Participants should note that Mahindra has made Tajonline (India) Private Limited
(trading as Grass Roots India and herein referred to as "Grass Roots India" a provider of
incentive and reward administration services) responsible for devising, implementing,
administering, overseeing and operating the Program. Participants should initially contact/deal
with Grass Roots India in respect of any queries/issues related to the eMPOWER Program. Only
those queries/issues that cannot be satisfactorily resolved by Grass Roots India will be
escalated to Mahindra for its decision.
1.19 We may contact you on email and / or SMS and / or call you regarding the program. By
accepting these Terms and Conditions, you are authorizing us to contact you. Your consent
indemnifies us from any liability arising out of the regulations like Telecom Do Not Disturb. We
will take due care as possible to respect your privacy and personal time. In case your mobile
number is registered under the National Do Not Disturb registry, you may not be able to receive
any promotional communication we send across.
